ED Releases Guidance on Civil Rights of Students with Disabilities
On December 28, the Department of Education’s Office of Civil Rights released three new sets of guidance to assist the public in understanding how the Department interprets and enforces federal civil rights laws protecting the rights of students with disabilities. The three documents included a parent and educator resource guide, a Dear Colleague letter, and a question and answer document o the use of restraint and seclusion in public schools. The DCL and the Guide discuss the rights of students with disabilities in public charter schools. Specifically, the Guide makes clear the Section 504 rights of students with disabilities if a charter school is a virtual or online and states that it must be ensured “that the technology is accessible to students with disabilities. This means that the technology must be accessible to students with disabilities when their disabilities affect their use of the school’s technology.” For more information, visit:
